Ladies and gentlemen,
I, being well versed in things and gadjets of an electomagnetic nature, post the following nuggets of wisdom:
#1 If the police use telemetry data from a privately owned device (such as your cell phone or the like) they must have a search warrant/wiretap (whichever applies). this would apply to a non-transmitting device that logs data (GPS, etc.) if they were to download your data. If they don't have a warrant it violates your right to privacy and is in admissable in court.
#2 if they use telemetry data with the permission of the owner (i.e. Rental car companies!!!) it is perfectly legal. I believe at least one TI member got nailed this way. oh BTW Lo-jack type devices installed in rental cars DO do this. this also includes transmissions from a device that is proprietary (you don't OWN it, you just lease or rent it)
#3 cops can lie thier asses off to get you to confess. Bring it up to the judge what he said. the judge will ask him (under oath) if he said it. when he admits to it you can pretty much guarantee your ticket will be reduced if not dismissed. Don't get me wrong I HATE soccer mom killing speeders so slow the
[email protected] down!
#4 don't freak out about this stuff yet. the ACLU and freedom loving organizations will put up a big stink if this crap happens. not to mention the techno-geeks that invent this stuff would be the first ones to tip off the media about it.
